Services Agreement

Welcome! We are extremely glad that you have chosen CSB / GQ Hosting as your full Internet Content Access Service Provider. We have prepared this agreement to allow you to make the best use of your new service. This agreement sets forth the rights, responsibilities and obligations of both you and CSB / GQ Hosting. By using the CSB / GQ Hosting Access Service you agree to abide by the terms and conditions of this agreement. CSB / GQHostings Online Policies are incorporated into this agreement.

This agreement may be revised from time to time as we offer additional features and enhancements to our service. You should review this agreement periodically on our web site to ensure that you stay up to date. Your use of the Service will confirm your agreement to its terms and conditions, as well as your acceptance of the changes we make to the agreement. Revisions may include changes in billing rates, service offerings, and terms and conditions.

You certify that you are at least eighteen years old and that the personal data you have provided to CSB / GQ Hosting is true and accurate. This personal data consists of your own name, address, telephone number, and billing information.

You agree not to resell or otherwise redistribute any part of the CSB / GQ Hosting Service or profit in any other way by providing access to others.

CSB / GQ Hosting takes steps to protect members' privacy. CSB / GQ Hosting will not provide information concerning your account to any third party without your express consent, unless required by legal process to do so, or when it comes to CSB / GQ Hostings attention that an emergency regarding the physical safety of someone is concerned. You agree to safeguard your account and your password. You are responsible for any misuse connected with your account.

CSB / GQ Hosting may revise its rates from time to time and will provide members with 15 days advance notice of such changes.

You may cancel your account at any time, There are no additional charges due upon cancellation. For services other than access service, such as web hosting and web design, there is no refund upon cancellation.

If you choose to be billed under the month to month plan and you have chosen to pay by credit card, you expressly authorize CSB / GQ Hosting to charge the credit card number you provided, for all charges incurred. These charges are payable in advance and CSB / GQ Hosting will continue to charge your credit card monthly, unless you terminate your account.

For annual or multi-year plans, you will receive an invoice for the continuing period on or about sixty days before the end of your term. If payment is not made by check or credit card by the expiration date of your term, your account will be cancelled.

You agree that all your ancillary costs connected with your use of our service are to borne solely by you. Examples of such costs are your telephone line charges and long distance charges, cost of your equipment, etc. CSB / GQ Hosting may choose to provide a toll free telephone number or a local access number from your calling area to allow toll free access. However, such choice is in the sole discretion of CSB / GQ Hosting.

You agree to refrain from any use of your CSB / GQ Hosting account which violates any Federal, state, or local laws and regulations. These laws include, but are not limited to privacy laws, decency laws, copyrights, trademarks, patents and other intellectual property laws. You will not use your account in any way that infringes on the rights, responsibilities, or obligations of any other CSB / GQ Hosting account member or CSB / GQ Hosting itself.

You will not use your account or the CSB / GQ Hosting service to gain unauthorized access to any areas, systems, networks, or organizations. You also agree not to post the same message to 20 or more newsgroups.

You understand that CSB / GQ Hosting does not operate, own or manage the Internet or the interconnecting networks to which you may gain access through CSB / GQ Hosting, and CSB / GQ Hosting has no control of the information or the accuracy of such information available through the media. You agree that any change in the information available through these media or in the access to these media is beyond the control of CSB / GQ Hosting.

CSB / GQ Hosting makes no warranties of any kind, whether express, implied or statutory concerning the information available through the CSB / GQ Hosting network. Your use of these media and any information derived therefrom is solely at your own risk and is subject to applicable national, state, local and international laws and regulations. You agree that CSB / GQ Hosting has no liability to you, whether in tort, contract or otherwise, for any and all claims arising out of the services provided by CSB / GQ Hosting. In any event, any legal proceeding in respect of any claim must be started within one year and shall be settled by final and binding arbitration conducted in the state of Virginia by a neutral arbitrator, in accordance with this agreement and the then current commercial arbitration rules of the American Arbitration Association . CSB / GQ Hosting will not be responsible for your expenses in connection with such an action.

You agree to abide by the terms of this Agreement and by CSB / GQ Hostings Online Policies.

CSB / GQ Hosting may restrict or terminate a member's access if we determine that the member is not abiding by the terms of this Agreement, including revisions. Such restriction or termination may be done without prior notice to the member. We may exercise our right to restrict or terminate access if we determine that the member is violating any provisions in this agreement.

The Agreement is governed by the laws of the commonwealth of Virginia.

CSB / GQ Hosting's Online Policies

To enable all our subscribers to enjoy the use of the CSB / GQ Hostings services, there is a Code of Conduct that must govern activities conducted on MEC/CSB’s site.

1. You will not use the CSB / GQ Hosting service to transmit, or engage in any of the following, where such use is a violation of law.

a. Obscenity or vulgarity

b. False advertising

c. Fraudulent or deceitful activities

d. Defamation, slander, or libel

e. Violation of copyrights, trademarks, patents, trade secrets

f. Abusive language, including threats, extortion, harassment,

g. Language which portrays racial, religious, ethnic or gender-based intolerance

h. Activities conducted under false pretenses

i. Violation of any law, whether Federal, international, state or local.

2. Using any CSB / GQ Hosting account or server to send duplicative, unsolicited e-mail messages (commercial or otherwise), or to collect the responses from unsolicited e-mail, is prohibited. Similarly, using any CSB / GQ Hosting account or server to post advertisements or messages that violate the charter of any newsgroup or mailing list is prohibited. CSB / GQ Hosting reserves the right to make the determination whether a given message violates the newsgroup or mailing list charter. In most cases CSB / GQ Hosting will defer to the judgment of the newsgroup or mailing list moderator or administrator. Commercial messages that are appropriate under the charter of a newsgroup or mailing list, or that are expressly solicited by the recipients, are permitted. Conduct in connection with e-mail or Usenet news that is an obvious nuisance (such as "mail bombing") or that would be unlawful in other contexts (for example, threats, harassment, defamation, obscenity, or software piracy) is prohibited.

3. You may use the chat and forum rooms to engage in any discussion that is lawful and is of interest to other users.

4. You will not abuse the CSB / GQ Hosting system by doing anything to inhibit the free flow of content to other users.

5. You will not post the same message to 20 or more users or newsgroups at the same time.

6. CSB / GQ Hosting has designated specific areas for posting or transmitting advertising content, solicitations or other promotional material. All material of this nature must be transmitted using these areas only.

7. The Internet provides many valid opportunities for meaningful and rewarding commerce. CSB / GQ Hosting has no control over advertising conducted via the Internet. You should always use judgment before conducting any transactions or transmitting any information over the Internet. CSB / GQ Hosting is not responsible for any transactions you conduct with third parties through the Internet. CSB / GQ Hosting shall not be held responsible or liable, either directly or indirectly, for any damages, liabilities, or losses suffered by your use of our Access Service.
